These terms govern valuations, offers and vehicle purchases carried out by TheOne Auto.
Applicable terms
Purpose
These terms govern the relationship between TheOne Auto and any natural or legal person offering a vehicle for purchase, referred to as the seller.
Valuation
A valuation given online or by an advisor rests solely on the information declared by the seller. It is an indication of value and not an offer to purchase in law. It does not bind TheOne Auto.
Firm offer
The firm offer is made after physical inspection of the vehicle and verification of the documents. It is provided in writing with an explicit validity period. It may differ from the initial valuation in light of what is found.
Seller obligations
The seller warrants that they are the lawful owner of the vehicle or hold written authority from the owner, and that the vehicle is free of any lien, objection or seizure proceedings.
The seller undertakes to declare in good faith the condition of the vehicle, its service history, any accident damage and the true mileage. Any inaccurate declaration affecting value may lead to the offer being revised or withdrawn.
Transfer of ownership and payment
Ownership transfers when the transfer documents are signed and the keys and vehicle documents are handed over. Payment is made by bank transfer to an account in the seller’s name within the SEPA area. No payment is made in cash.
Administrative formalities
TheOne Auto handles the transfer and deregistration formalities applicable in the country of registration. The seller remains responsible for cancelling their insurance policy after ownership transfers.
Vehicle sold as seen
The vehicle is bought as seen, TheOne Auto acting as a motor trade professional with the technical competence to assess its condition at inspection.
Right of withdrawal
The sale of a vehicle by a private individual to a professional does not fall under the distance selling rules protecting consumers. The seller nevertheless remains free to decline the offer up to signature of the transfer documents.
Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these terms.
Governing law and disputes
These terms are governed by French law. In the event of a dispute the parties will seek an amicable solution before any legal action, subject to any mandatory consumer protection rules that may apply in the consumer’s country of residence.
